The complex relations between the criminal process and the exercise of Parliamentary Functions
Main Article Content
Abstract
Preliminary criminal investigations, in which the perpetration of criminal offenses can be attributed to parliamentarians, present their own specific profiles causing the criminal procedure to undertake a partially different path from the standard. In these instances, the intervention of the Legislative Chamber and the peculiarities of the status of the person under investigation, derived from the prerogative of parliamentary immunity, are required. On the other hand, the criminal investigation may be interfered with by parliamentary investigative committees whose objectives are the same as those being investigated within the criminal jurisdiction.
