The comprehensive management of migration and borders as a strategic priority of the European Union: or when a solidarity à la carte is put at the service of security

Abstract
It is a strategic challenge for the European Union to apply a comprehensive approach to migration and border management, in order to place it within the framework of a “new era of security and defense for Europe” Thus, a distinctly security-oriented perspective or approach to the migration phenomenon is adopted, in line with the paradigm shift generated in the European Union as a result of the so-called “refugee crisis,” after which migratory flows are perceived primarily as a threat, to be prevented or neutralized. Thus, within the framework of the new Pact on Migration and Asylum, approved by the European Union, Regulation 2024/1351, on asylum and migration management, is inspired by this guiding principle, essentially maintaining the responsibility of front-line Member States, which constitute the Union’s external border, to examine applications for international protection and to prevent the entry of “faulse refugees”, while establishing, as compensation, an annual solidarity contingent and solidarity mechanisms, which are mandatory, although of discretionary and limited in scope, to assist them and carry out an equitable distribution of responsibilities, but whose application is complex and uncertain.
