Abstract

SUMARIO: Introducción. Consideraciones previas en torno a los mecanismos de creación normativa en materia penal durante el siglo XIX: la poca participación de las Cortes en el desarrollo de la Ley penal. La derogación por anulación del Código penal de 1928 y la segunda vigencia del Código penal de 1870. Peticiones de su derogación. El advenimiento de la Segunda República y la derogación por anulación. La segunda vigencia del Código de 1870 hasta la promulgación del Código de 1932. Epílogo: Los mecanismos de creación normativa durante la Segunda República y el Franquismo.
