Abstract
SUMARIO: 1. La necesidad de modernizar la teoría y el método del Derecho Constitucional italiano-2. Las raíces teóricas e históricas del formalismo estatalista predominante en la dogmática constitucional italiana.—3. LA dogmática del derecho estatal alemán como fundamento teórico del formalismo en el derecho público y su disolución en Weimar.—4. La democracia pluralista comporta la primacía de la constitución y en el plano teórico la superación del formalismo jurídico.—5. La teoría constitucional como teoría de los valores constitucionales.—6. Conclusiones.
