Abstract
The European Court of Justice clarifies in this judgment, in addition to the moment of acquisition of the status of Member of the European Parliament (MEP), the personal, temporal and material scope of the immunities enjoyed by said MEPs. The Court held that a person who is elected to the European Parliament acquires the status of a parliamentarian as a result of the elections once proclaimed by the electoral board and, from the moment of the declaration of the results, enjoys the immunities guaranteed by article 9 of the Protocol (No. 7) on EU privileges and immunities.
